Proposal for adopting the revised safety inspection regulations of Information Technology Equipment

Background:
Up to the present time, the ITE, multimedia equipment and similar products (HS: Chapter 84& 85) have to be subject to mandatory inspection in accordance with CNS 13438 (harmonized with CISPR 22) standard and CNS 14336 (harmonized with IEC 60950). In order to enhance protection of consumers, the BSMI will adopt the revised standard CNS 14336-1 (2010) as new safety testing standard, instead of the current CNS 14336 to implement inspection toward the above-mentioned products from January 1, 2012. The CNS14336-1 standard "Information technology equipment – Safety – Part 1:General requirements ", as established on September 30, 2010, is harmonized with IEC 60950-1: 2005.

Products (HS/CCCN codes) covered and their applicable inspection standards:
The information technology equipment, multimedia equipment and similar products (HS: Chapter 84& 85) which are subject to mandatory inspection regulated by the BSMI and the preset safety testing standard of which is CNS 14336.
Related requirements:
1. Starting from January 1,2012, the above-mentioned regulated ITE, multimedia equipment and similar products(HS: Chapter 84& 85) whose current safety testing standard is CNS 14336 must conform to testing items of CNS 14336-1(2010) instead. The products covered include commodities which use AC power directly or use power conversion devices to function themselves.
2. Starting from the implementation date, products covered in this notice shall comply with the new safety standard CNS 14336-1(2010) when the application for the Registration of Product Certification (RPC) or Type Approval (TA) certificate is submitted to BSMI. The BSMI will accept such applications complying with the above-mentioned safety testing items starting from the date of promulgation of this notice. When the BSMI completes the review procedure and approves the application, a new certificate will be issued and “the applicable inspection standard” column of this certification will be additionally stated with words “CNS 14336-1(2010)”.
3. For those products which have been certified before date of implementation, if the RPC or TA certificates are issued under the situation that the above-mentioned CNS 14336-1(2010) testing items have not yet been performed, these certificates will remain valid until the expiration date of these certificates, provided that the products, including main model, are not modified. In this situation, application for adding serial models registration to these certificates according to original CNS 14336 safety testing standard is still acceptable.
4. For the products covered in this notice, either the new application for RPC or TA certificate raised before December 31, 2011, or the certificates that are still valid are raised to apply for extension before December 31, 2011, the electrical safety testing items of these two situations can be performed according to original CNS 14336 standard. If the tests and review process are all right, a new RPC or TA certificate will be issued and its validity period will be still 3 years. However, if the above-mentioned new application case or extension application case is raised after January 1, 2012, the electrical safety testing items must comply with CNS 14336-1(2010).
5. If the main model and serial model(s) of an issued RPC or TA certificate can pass the electrical safety test according to CNS 14336-1(2010), the original certificate holder can apply to testing labatory to get a type-test report. Then, the certificate holder can file an application for either modification of the original certificate or re-issuing a new certificate with the above-mentioned type-test report and the original certificate (used as a proof technical document for EMC testing item). After the review process, the modified original certificate (its certificate number is the same) or the new certificate will be additionally stated with words “CNS 14336-1(2010)” at “the applicable inspection standard” column. The validity period of the modified certificate is that of the original one. As for the new certificate, its term of validity is 3 years starting from the re-issue date, and the original certificate will be cancelled at the same time.
6. If a new product covered in this notice can pass the electrical safety test according to CNS 14336-1(2010), and it would be intended to be registered under some original RPC or TA certificate and become an additional serial model, the registration can be approved only after those original main model and serial models can also pass the electrical safety test according to CNS 14336-1(2010) and the original certificate holder must first get the modified certificate or a new certificate following the procedure explained in point 5.
7. For ITE products covered in this notice, the National Certification Body (NCB) under the IECEE CB Scheme can apply to the BSMI for registration. After the application is approved, the equivalent IEC 60950-1:2005 safety test report issued from his associated CBTL combined with CB certificate can be forwarded to domestic BSMI-recognized testing labatory to be transformed into a test report that can be accepted by the BSMI.
8. For the products covered in this notice and they are required to comply with the Declaration of Conformity (DoC) inspection scheme, those original declarations are effective only until December 31,2011. The obligatory inspection applicant shall first get the type-test report that proves his original DoC product can pass the safety test according to CNS 14336-1(2010) and signs the related DoC document again before placing that product into Taiwan market after the implementation date.
